GENERAL TERMS AND CONDITIONS
Oggies Music is a sole trading company that operates this site, correspondence can be sent to Oggies Music at 3 Bell House Place, 11 London Road South, Merstham, Surrey, RH1 3AZ. 1. The contract between Oggies Music and the Customer
The goods must be paid in full and the payment received in for the goods that you order before we accept your order. When you make your payment, this represents an offer that you are to purchase the goods, which we will accept and confirm by email that the goods have been sent to the address provided by you. This acceptance forms a legally binding contract between us.
2. Availability of Goods
Any order is dependant on its availability and acceptance. Where the ordered items are not in stock, we will contact via phone or e-mail depending on the details you have provided. At this point you will have the option to cancel or wait for the items to be available.
3. Ordering mistakes
Mistakes in the order process can be corrected up until the point that the order is “Submitted” during the ordering process.
4. Price
The prices shown on the website are the price payable, inclusive of the appropriate VAT when the items were posted.
If we are unable to fulfil your order as per the price or description we will notify you via e-mail, the email may contain an offer for a set period of time for the goods, including the price and specification.
5. The payment terms
Providing the order can be completed within 30 days a charge will be made to your credit account for payment. If full payment is not made then the order will be put on hold or cancelled. No liability can be accepted should incorrect details be provided. Oggies Music may have other rights in addition to those stated here.
6. Delivery charges
There are no refunds for delivery charges, which are dependent on the items ordered.

b. Oggies Music do not accept any liability for the good once they have been delivered.
c. Please ensure that you provided an accurate delivery address as this is where the order will be delivered
d. When the ordered has been delivered as per your instruction, Oggies Music unless due to our negligence will not accept any claim for loss or damage.
e. The website contains the cost of delivery.
f. It may not be possible to deliver to all location and on some occasions it may be necessary to request extra payments for deliveries.
g. No delivery times are guaranteed, however we will make best endeavours to dispatch the good in a timely manner.
h. If we are aware of delays we will notify these as early as possible.
i. Once the goods have been delivered, then ownership then becomes yours, Oggies Music is no longer liable for any loss or damage.
j. Oggies Music will make all possible efforts to dispatch in stock orders within 48 hours, however please be aware that on some occasions delays may occur during busy periods.
k. If you would like a prompter service please advise us at time of ordering.
7. Risk and ownership of Goods
a. Please be aware that none of the goods supplied are intended for resale.
b. Ownership changes from us to you once the goods have been paid in full and delivered to you. There is no liability after delivery for Damage or Loss to Oggies Music.
c. When returning good as in 10a.and 10b, liability for damage and loss remains yours until delivered back to Oggies Music.
d. Acknowledgement and acceptance of your order
e. Oggies Music can only provided ordering, dispatch and delivery notification when a valid e-mail address is provided.
8. Cancellation rights
The Distance Selling Regulations set out your legal rights
a. You can cancel your order, without a reason or penalty within seven days of receipt of your goods, excluding made to order items. Any contract will have to be notified.
b. There is no contract cancellation on magazines, audio or video recordings, computer software that was supplied in sealed packaging.
c. If the goods have already been delivered and are not excluded as in b. above you must return at your own cost to our contact address.
d. If you have been sent the goods and you cancel your contract, you must not unpack them and return them at your own cost to our contact address.
e. Returns under a. and b. are at your own risk for loss or damage.
f. Following the cancellation of the contract, your account will only be credited when the goods have been returned in the same condition as supplied. If this criteria is fulfilled then this will be done as soon as possible, but within 30 days of your order.
g. If the goods are not retuned the cost of recovery, including delivery cost will be deducted from the amount to be credited.
h. When goods are faulty or unsatisfactory costs will be credited.
9. Cancellation by Oggies Music
a. Oggies Music reserve the right to cancel the contract between us if:
i. Due to insufficient stock.
ii. Unable to deliver to your area.
iii. If items were listed incorrectly due to a typographical error or an error in the pricing information received by us from our suppliers.
b. Any cancellation will be notified by e-mail, your account will be credited as soon as possible, but in any event within 30 days of your order.
10. Liability
a. When the goods have not been received within 30 days and you have informed us in writing at our contact address within 60 days of the order date, with the exception of reason. Oggies Music only obligation will be either:
i. Make up any shortage or non-delivery.
ii. Replace or repair goods.
iii. Refund the amount paid in whatever way we choose.
b. Liability for losses by both parties are limited to only those which are reasonable foreseeable consequence of the breach of contract.
c. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the importation or exportation of certain goods to you. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
d. Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under the applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
11. Notices
Oggies music will display any notices to its customer via the website, any notices from customers should be sent in writing to Oggies Music, 3 Bell House Place, 11 London Road South, Merstham, Surrey, RH1 3AZ.
12. Changes to legal notices
Oggies Music may occasionally change these terms and conditions and will not notify individuals directly; therefore customers are advised to read them as often as possible.
13. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
14. Privacy
Oggies Music have a privacy policy and you agree to be bound by that policy.
15. Third party rights
These terms and condition are not to affect any rights on a third party.
